Please read these terms and conditions in conjunction with our estimate and letter of exclusions document attached.
Our price remains firm for 30 days from the date hereon.
All acceptances must be in writing by way of our acceptance form (attached), official order, fax, email or post.
Cooling off period (for Private Customers) of 7 days starting with the date of receipt by the consumer of notice of the right to cancel.
All work would be in re-measurable on completion.
Terms of payment are 14 days from date of Invoice.
We require payment to terms. Payment must be made on time, in full, and without any deduction, set off or counterclaim. In the event that an account is outstanding, we will refer the matter to our collection agents, Daniels Silverman Limited, which will incur costs of 15% + VAT. Any costs incurred to collect the debt will be added to the debt, plus VAT at the prevailing rate. You agree that you will be legally liable to pay us that surcharge, and that payment of the same can be enforced against you in court. You also agree to pay interest at the relevant reference rate provided for under the Late Payment of Commercial Debts (Interest) Act 1998 and subsequent amendments, which interest is payable both after and before any judgement of the court and continues to accrue.
No allowance has been made for retentions or main contractor discounts.
All materials remain the property of S P Bardwell Ltd until full and final payment of the account is received.
Full payment can be requested before the commencement of works at the discretion of the Managing Director.
Twelve months warranty on our installation providing full and final payment is received. In consumer contracts, this warranty is given in addition to your statutory rights provided by the Supply of Goods and Services Act 1982 and your right to set-off.
Our works and prices would be subject to a full site survey prior to entering into any contract.
All work would be subject to a final measure and charged against the rates estimated.
The estimated works are based on good ground conditions ie: clay etc: The breaking out of rock or concrete structures would be chargeable as extra over the quoted prices.
Any pumping or de-watering of excavations would be chargeable as extra over the estimated prices.
Applications for planning permissions, building regulations, approvals and consent to discharge are excluded from our contract.
Any local or other authority fees levied on the works are excluded.
It is the clients' responsibility to provide S P Bardwell Limited with any details of below ground services that may run through the private site. S P Bardwell Limited can not be held responsible for any damage to below ground services that fall outside our control due to lack of information.
S P Bardwell Limited would expect the client to provide free of charge, access to our works, water, power and storage area for the duration of the works.
Only works as described within our estimate are covered, any additional works would be subject to extra cost.
